These Terms of Service (“Terms”) govern your use of all services, websites, events, programs, consulting, digital products, and client services provided by PersonalBrand.com, LLC and Entourage Marketing, LLC (collectively, “PersonalBrand.com,” “we,” “us,” or “our”). By accessing, purchasing, registering for, or engaging with any service we provide, you agree that you have read, understood, and accepted these Terms and our Privacy Policy. If you do not agree with these Terms, you may not use our Services.
1. Scope of Our Services
PersonalBrand.com provides a variety of offerings, which may include private client services, branding and design work, consulting, business strategy, live events, workshops, seminars, online courses, membership portals, downloadable content, community channels, and tools to help clients build, grow, market, or monetize a personal brand. Any new features or tools we add are also governed by these Terms.
2. Communications
By creating an account or making a purchase, you agree to receive emails, newsletters, promotional updates, and service-related communications. You may unsubscribe at any time using the links provided in our emails.
3. Purchases & Payment
To complete a purchase, you may be asked to provide billing details including your name, address, and payment information. You represent that you have the legal right to use the payment method provided and that all information you submit is accurate and complete. We may use third-party payment processors, and by submitting information you authorize us to share it with such processors according to our Privacy Policy. We reserve the right to refuse or cancel any order due to availability issues, suspected fraud, pricing errors, or incorrect order information.
4. Pricing, Availability & Errors
We continuously update our offerings and may experience delays in displaying accurate information. Products or services may be mispriced, inaccurately described, or temporarily unavailable. We reserve the right to correct errors, change information, adjust prices, or modify offerings at any time without notice.
5. User Content
You may be able to upload or submit content through our Services (“User Content”). You are responsible for ensuring that your content is lawful, accurate, and appropriate. By uploading content, you represent that you own it or have permission to use it, and you grant us a worldwide, royalty-free license to use, display, store, reproduce, and distribute it for the purpose of operating our Services. You retain ownership of your User Content. We may remove or restrict content at our discretion.
6. Accounts
You must be at least 18 years old to create an account. You agree to provide accurate information and keep your credentials secure. You are responsible for all actions under your account. You must notify us immediately of any unauthorized access. We may suspend or terminate accounts at our discretion.
7. Digital Products, Online Courses & Licensing
Purchases of digital products and online programs provide a personal, non-exclusive, non-transferable license for your individual use only. You may not share, resell, redistribute, or commercially exploit our content without written permission. We may revoke access for violations of these Terms. Subscription-based products require an active paid account to maintain access.
8. Live Events & Ticket Purchases
8.1 Event Payments & Refunds
Unless otherwise stated on the event sales page, events follow the Product Refund Policy in Section 10. After the refund window closes, all ticket sales are final.
8.2 Event Changes
We may modify event schedules, speakers, agendas, or timing. We may postpone or reschedule events. Such changes do not entitle attendees to refunds outside the stated refund policy.
8.3 Safety & Conduct
You agree not to engage in unsafe, unlawful, or disruptive behavior. We may remove attendees from an event without refund for violations.
8.4 Media Release
By attending any event, you grant permission for us to photograph, video record, and use your likeness for marketing and promotional purposes.
9. Product Delivery
Digital products and online course access credentials are typically delivered via email within 24 hours. You must maintain active payments to retain access to any subscription product.
10. Refund Policy
10.1 Services (Client Services, Private Client Work, Consulting)
All payments for Services are non-refundable. Payments represent allocation of time, resources, and project availability that cannot be recovered once reserved.
10.2 Products (Tickets, Digital Courses, Programs)
Products include a 30-day, 100% money-back guarantee unless the sales page states otherwise. After 30 days, no refunds will be issued. To request a refund, email support@personalbrand.com.
11. Termination
11.1 Client Services
Client Services may be terminated with 30 days written notice. Payments already made are non-refundable and payments due within the notice period remain payable. Future payments due outside the notice period will be waived.
11.2 Digital Product Access
We may suspend or terminate accounts for violations of these Terms, illegal behavior, abusive conduct, or non-payment of subscription fees.
12. No Guarantees / No Professional Advice
We do not guarantee specific results, outcomes, business performance, or earnings. Results vary based on individual circumstances. Nothing in our Services constitutes legal, financial, or professional advice. You are solely responsible for your decisions and actions.
13. Third-Party Links
Our Services may contain links to third-party websites. We are not responsible for their content, policies, or practices. Some links may use affiliate tracking. We only recommend products we believe in, but we are not responsible for third-party offerings.
14. Indemnification
You agree to defend, indemnify, and hold harmless PersonalBrand.com, LLC, Entourage Marketing, LLC, and their employees, officers, partners, contractors, and agents from any claims, damages, losses, liabilities, or expenses arising from your use of the Services, your violation of these Terms, your content, or your violation of third-party rights.
15. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or goodwill. Our total liability for any claim shall not exceed the amount you paid for the relevant Service. You use the Services at your own risk.
16. Disclaimer of Warranties
The Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service, correction of defects, or that results will meet your expectations.
17. Governing Law
These Terms are governed by the laws of the State of Arizona. If any provision is held invalid, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and us.
18. Changes to These Terms
We may update these Terms at any time. Users are responsible for reviewing these Terms periodically for changes. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
